Divorce mediation for a foreign spouse

 

K&P Law Firm represented a foreign husband living abroad in a divorce mediation case.

Background

A foreign husband (I will refer to him as the United States for convenience here. It is different from the actual case.) X and his Korean wife Y got married about 10 years ago and they had a child Z. The couple decided to divorce and raise Z in the United States for Z's education. the husband X returned to the United States about 5 years ago to find his job and has raised Z.

 

However, these couples have been separated for a long time and their relationship has become estranged, and X in the United States and Y in Korea, have a stable social status in each country. So one cannot give up the status for the other.

 

X and Y wanted to finalize their divorce quickly.

 

What we did

 

We consulted husband X in the United States and wife Y in Korea and proceeded with the following works.

• In the case of divorce by agreement, there is a period of consideration, and in some cases, counseling from a counselor appointed by the court may be required. In the case of divorce by agreement, the parties must appear in court to confirm their intention to divorce. Therefore it is inconvenient for X to visit Korea and attend the hearing in the court.
• We recommended applying for divorce mediation to the couples. By adjusting the conditions between the two couples, they reached an agreement on various conditions related to divorce (property division, parental rights of children, child support, etc.).
• We prepared and submitted the application for divorce mediation on behalf of husband X, and represented X on the mediation date.
• Wife Y attend the mediation date without an attorney. However, we guided her on what to do and what to say in the mediation procedure.

Result

We filed a divorce mediation application on behalf of X. The divorce mediation took place in about 3 months, and the divorce was completed in one day.

 

X completed the divorce smoothly without the inconvenience of visiting Korea and without facing each other.
